Terms of Service

1. Services Provided

We offer CRM setup, automation tools, appointment booking, messaging, marketing campaigns, and other business services powered by ProdigalSuite. Services are billed monthly and include access per your selected plan.

Exclusions: Setup services (e.g. customization or campaign design) may have separate, quoted fees.

2. User Responsibilities

You agree to:

Provide complete, accurate business info and assets (logos, brand guidelines, etc.).

Use the platform lawfully—no spam, unlawful content, or misuse.

Maintain your own backups of data, content, and files.

3. Trial Period & Billing

You receive a 7-day free trial with usage credits. After the trial ends, your card will be charged unless you cancel. You’re responsible for any platform usage fees (SMS, calls, email sends) above included credits.

4. Seat & Contact Limits

Your plan includes a set number of user seats and a contact limit. We’ll notify you as you approach any limits; excess usage may require upgrading to avoid service disruption.

5. Support & Downtime

Basic support is included via chat/email. Setup support or custom migrations may be offered separately. We strive for uptime but don’t guarantee against outages. You’ll be notified promptly of any planned downtime.

6. Refunds & Cancellations

We don’t offer refunds. You may cancel anytime—services will remain active until the end of your billing cycle. Be sure to export all data before cancellation.

7. Intellectual Property

Everything you upload (contacts, media, copy) is yours. We retain rights to our software, integrations, and proprietary configurations or automations created by us.

8. Privacy & Security

We follow industry best practices. Your data remains private and secure, and is only shared with approved third-party services (e.g. SMS providers, email gateways). See our Privacy Policy for full details.

9. Liability Limits

We are not liable for indirect or consequential damages (e.g., lost profits). Our total liability won’t exceed what you paid us in the past 6 months.

10. Revisions to Terms

We may update these Terms occasionally. Continued use after changes are posted constitutes agreement.

11. Governing Law

These Terms are governed by the laws of the State of Minnesota, United States. Any disputes arising from these terms shall be resolved in the state or federal courts located in Minnesota.

Ownership & Contact Info: Name, business name, email, phone, address.

Account Data: Usage metrics, communications, customer info uploaded to ProdigalSuite.

Transaction Data: Invoices, payment history, service usage.

Provide & support services (account setup, billing, support responses).

Improve system functionality (bug fixing, feature analytics).

Do I need to install anything?

Nope. ProdigalSuite is 100% cloud-based.

What happens after the free trial?

You’ll keep everything you’ve already set up — your leads, your automations, your templates. You can choose to upgrade to a full plan anytime during or after the 7-day trial. And yes, your usage credits from the trial go toward real activity (like texts, calls, etc.).

Can I add my team or assistants?

Yes. Every plan includes multiple seats, so you can bring on your assistant, sales team, or contractors. You can also control their access levels — whether you want them managing messages, sending invoices, or just checking calendars.
